In these Terms, "we", "us" and "our" mean OWVRSZ. "You" means the person using this website or placing an order.
2. AGREEMENT TO THESE TERMS
By browsing owvrsz.com or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Shipping Policy and Returns and Refunds Policy, each of which forms part of this agreement.
If you do not agree, please do not use the site.
We may update these Terms. The version published on this page at the time you place an order is the version that applies to that order. Changes do not apply retroactively to orders already accepted.
3. ELIGIBILITY
You must be at least 18 years old, or the age of legal majority in your country of residence, to place an order. If you are under that age, you may only use this site with the involvement of a parent or legal guardian.
4. PRODUCT INFORMATION
We describe our products as accurately as we can, including fabric composition, fabric weight in GSM, and flat garment measurements.
Our garments are cut to an oversized fit. Please check the measurements published on each product page before ordering. Measurements are taken from the garment laid flat and may vary by up to 2 cm due to the nature of cut-and-sew production.
Screen and device settings affect how colours appear. We cannot guarantee that the colour shown on your screen exactly matches the garment.
5. PRICES, VAT AND CHARGES
All prices displayed on this website are in UAE Dirhams (AED) and are shown exclusive of VAT.
VAT at 5% is added at checkout on orders delivered within the United Arab Emirates. The total price payable, including VAT and any delivery charge, is shown to you before you confirm your order.
Orders delivered outside the UAE: UAE VAT is not charged on goods exported from the UAE. Customs duties, import taxes and any charges levied by the destination country are payable by you as the recipient and are not included in the price shown at checkout. These are set by the destination country and are outside our control.
We may change our prices at any time. A price change does not affect an order we have already accepted.
6. PROMOTIONS AND DISCOUNTS
Where we advertise a discount, the reference price shown is a price at which the product has genuinely been offered for sale.
Promotions run for the period stated. Discount codes may not be combined unless we say so, cannot be exchanged for cash, and may be withdrawn where they have been obtained or used in a way we reasonably consider abusive.
7. ORDERS AND ACCEPTANCE
Placing an order is an offer to buy. Our order confirmation email acknowledges receipt but does not itself form a contract.
A contract is formed only when we despatch your order or confirm acceptance in writing.
We may decline or cancel an order where the item is out of stock, where there has been a pricing or description error, where we cannot verify your payment or delivery details, or where we reasonably believe the order is placed for resale. If we cancel an order you have already paid for, we refund you in full.
We may limit quantities per customer, per household or per order.
8. PAYMENT
We accept the payment methods displayed at checkout, including Visa, Mastercard, Apple Pay, PayPal, and instalment payment through Tabby and Tamara.
Tabby and Tamara are independent providers. Their instalment terms are a separate agreement between you and them, and we are not a party to it.
Payment is processed securely and card details are encrypted in transit. We do not store full card numbers.
You confirm that the payment method you use is yours or that you are authorised to use it.
9. DELIVERY
Delivery timeframes are set out in our Shipping Policy and on each product page.
Delivery estimates are estimates, not guarantees. Delays caused by couriers, customs clearance, weather or events outside our reasonable control do not entitle you to cancel an accepted order, though we will keep you informed and help resolve any problem.
Risk in the goods passes to you on delivery to the address you provide. Please make sure the address is correct, as we cannot redirect a parcel once it has been despatched.
10. RETURNS, EXCHANGES AND CANCELLATION
Our full Returns and Refunds Policy is available here and forms part of these Terms.
In summary:
- You may return an unworn, unwashed item in its original condition with tags attached within 7 days of delivery.
- Exchanges for a different size are free within the UAE.
- Refunds are issued to the original payment method within 1 to 2 working days of us receiving and inspecting the returned item.
- Return shipping is free.
Returns address: [FULL STREET ADDRESS], Meydan, Dubai, United Arab Emirates. Please note this differs from our registered address above. Do not send returns to the registered address.
If an item arrives faulty, damaged or not as described, contact us at customercare@owvrsz.com within 7 days of delivery and we will replace it, exchange it or refund you.
Nothing in these Terms limits your statutory rights under UAE consumer protection law.
11. INTELLECTUAL PROPERTY
The OWVRSZ name, the OWVRSZ logo, DJOW, all garment designs, all Arabic calligraphy artwork, all graphics, photography, video, text and layout on this website are owned by us or licensed to us, and are protected by UAE and international intellectual property law.
You may not reproduce, copy, distribute, manufacture, resell or create derivative works from our designs or brand assets without our prior written permission.
Purchasing a garment gives you ownership of that garment. It does not give you any right in the design, the artwork or the brand.
We take infringement seriously and will pursue counterfeiting and unauthorised reproduction.
12. YOUR CONTENT
If you post a review, comment, photograph or video about our products, or tag us on social media, you grant us a non-exclusive, royalty-free licence to use, reproduce and display that content in our marketing, on our website and on our social channels, with credit where practical.
You confirm that the content is yours to share, that it does not infringe anyone else's rights, and that it contains nothing unlawful, offensive or misleading.
We may remove any content at our discretion. We are not obliged to keep your submissions confidential or to pay for them.
If you want content of yours removed, email customercare@owvrsz.com and we will do so.
13. ACCEPTABLE USE
You may not use this website to break any law, to infringe our rights or anyone else's, to upload malicious code, to scrape or harvest data, to interfere with the security of the site, or to harass or abuse any person.
We may suspend or terminate your access if you do.
14. PERSONAL DATA
We process personal data in accordance with our Privacy Policy and with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data.
You can withdraw consent to marketing at any time using the unsubscribe link in any email or by contacting customercare@owvrsz.com.
15. THIRD-PARTY LINKS AND SERVICES
Our site links to and integrates with third-party services, including payment providers, delivery partners and social platforms. We are not responsible for their content, policies or practices. Please review their terms directly.
16. LIABILITY
We take reasonable care to keep this site accurate and available, but we do not guarantee that it will be uninterrupted or free of errors.
To the fullest extent permitted by UAE law, we are not liable for indirect or consequential loss arising from your use of the site.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under UAE law. Nothing in these Terms removes or reduces your mandatory rights as a consumer under UAE law.
17. COMPLAINTS AND DISPUTES
If something goes wrong, contact us first at customercare@owvrsz.com or +971 50 865 5259. We aim to respond within 12 hours.
If we cannot resolve your complaint, you may escalate it to the UAE Ministry of Economy consumer protection service on 600 522 225, through the Ministry of Economy website, or to the Department of Economic Development in your emirate.
18. GOVERNING LAW AND JURISDICTION
These Terms are governed by the federal laws of the United Arab Emirates, including Federal Law No. 15 of 2020 on Consumer Protection and Federal Decree-Law No. 14 of 2023 on Trading by Modern Technological Means.
Disputes are subject to the exclusive jurisdiction of the Sharjah Courts, United Arab Emirates.
If you are a consumer resident outside the UAE, this does not deprive you of the protection of the mandatory consumer laws of your country of residence.
19. LANGUAGE
These Terms are published in English and Arabic. In the event of a conflict between the two versions, the Arabic version prevails.
20. GENERAL
If any provision of these Terms is found unenforceable, the remaining provisions continue in force.
Our failure to enforce any provision is not a waiver of it.
These Terms, together with the policies referred to in them, form the entire agreement between you and us regarding your use of this website.
